Three Men Arrested In Connection With Colby Wildfire

Three men have been arrested for allegedly setting a brush fire that burned over 1,700 acres in the foothills above Glendora, Thursday. The men claimed they were sitting around a camp fire in the foothills when a breeze kicked up, starting the fire, now dubbed the Colby Fire.

Glendora police took three men into custody and booked them for recklessly starting the Colby Fire. They have been identified as Clifford Eugene Henry, Jr., 22, of Glendora; Jonathan Carl Jarrell, 23, of Irwindale; and Steven Robert Aguirre, 21, homeless of the Los Angeles area.

The trio were allegedly tossing papers into the campfire and allege that a gust of wind fueled the small campfire into a monstorous blaze.

The three men initially denied their involvement. However, two of the men were seen running away from the mountains when first responders arrived, and a third man was taken off the mountain by the U.S. Forest Service.

Police found marijuana and cigarettes in the backpacks of two of the men. Jarrell and Aguirre had no prior convictions in Los Angeles, Orange or San Bernardino counties, according to online court records. However, Henry pled no contest on Oct. 10, 2013 to a misdemeanor count of lewd conduct in public and was sentenced to 36 months probation, eight days in county jail and ordered to attend Alcoholics Anonymous for a year, according to Frank Mateljan, spokesman for the Los Angeles City Attorney’s Office.

Their bail is currently set at $500,000 for each man, raised from the initial $20,000 due to the seriousness of their crime, the cost of property damage, and the resources consumed during the fire battle. The fire, which erupted in dry and windy conditions, destroyed five homes and forced thousands of residents to evacuate.

The men will face federal charges when they make their first court appearance Tuesday as the fire was started on federal land.

Law Enforcement Cracking Down on DUI This Holiday Season

More than 1,700 people have been arrested in the winter holiday DUI crackdown in LA County, according to the Sheriff’s Department. Los Angeles County law enforcement officers have arrested nearly 1,700 motorists on suspicion of intoxicated driving during the last 15 days as part of an annual holiday crackdown.
Between Friday, Dec. 13 and Thursday, Dec. 25, officers from 100 county law enforcement agencies have arrested 1,700 people – almost 100 more arrests this year than during the same period in 2012.The DUI crackdown is part of the Avoid the 100 DUI Campaign and involves checkpoints and directed patrols.
This New Year’s Eve, a Maximum Enforcement Period will be in effect beginning Dec. 31 at 6 p.m. until midnight Jan. 1. One hundred law enforcement agencies are participating in the campaign, and the patrols will continue through New Year’s Day.

For the 17th year, AAA is offering it’s free Tipsy Tow service to help drunk drivers stay off the road.
Between the hours of 6 p.m. on Tuesday, Dec. 31 and 6 a.m. on Wednesday, Jan 1, AAA will tow you and your car home – up to seven miles – whether you’re a triple-A member or not. Simply call 1-800-400-4AAA and tell the operator, “I need a Tipsy Tow.” A truck will be dispatched, and will tow both the driver and their car.


If you are thinking of driving, call AAA instead. Even if you’re unsure whether or not you’re over the legal limit, with a service such as the one offered by AAA, it’s better to be safe.

Motorist Fatally Crashes Into Mission Viejo Home

Drinking and driving has caused another tragedy this holiday season in Orange County.

A motorist has been arrested this afternoon and accused of driving his car into a Mission Viejo home, killing a resident inside. The home’s layout had a bedroom in the front portion of the home. The driver went through the room, killing the resident inside sleeping in bed. The motorist allegedly has a suspended license and a history of DUIs.

The motorist has been identified as Kourosh Keshmiri, 27, of Mission Viejo. Keshmiri crashed a late-model Cadillac sedan into a bedroom of a home, killing a man who was asleep in bed, authorities said. The house was at least 30 feet from the street. The victim’s identity has not yet been released.

The one-story dwelling sits at a traffic elbow, where Pacato Drive and Olivera Drive meet at a right angle. A car that failed to make the right turn from Olivera onto Pacato would be going straight toward the victim’s residence.

The house sustained major damage, and investigators were checking its structural integrity. Crews repaired a ruptured gas line.

Keshmiri suffered minor injuries, as did a passenger in his car, authorities said. The passenger was interviewed and released.

According to a statement from the Orange County Sheriff’s Department, Keshmiri had a prior misdemeanor DUI conviction in August 2010 and a pending case from June. His driver’s license was suspended as a result of the incident earlier this year.

After Sunday’s crash, officers booked Keshmiri on suspicion of felony DUI with a prior conviction. He may face additional charges after the investigation is complete. Allegedly, alcohol and speed were factors in the collision.                                                
No one else in the home was injured.

Disturbing the Peace - PC 415

California Penal Code Section 415 is helping keep the peace all over the city. According to PC 415, any individual under the following cases will be imprisoned to the county jail for 90 days, he will be liable to pay a fine of $4,000.00, or both:

·        If an individual unlawfully fights in the public place or he challenges some other person to fight him in the public place.

·        If an individual maliciously or willingly disturbs someone else by loud or unreasonable noise.

·        If an individual uses offensive words which can provoke violence in the public place.

PC 415 is a broadly-written law that can cover any behavior that can disturb the peace.  If you see people at a bar fighting, if you are having an argument with your neighbor because of loud music which is disturbing them then you can be charged under the provisions of the law.

Defenses to PC 415
The good news is a PC 415 charge is often hard for prosecutors to prove which makes it easier for the defense attorneys to defend your case. Before you go to court facing these charges, it is recommended to discuss your case with a criminal defense attorney to protect your rights.

·         His behavior was protected constitutionally

Black Friday Violence is Seen Throughout the Nation

Shoppers eager to take advantage of Black Friday deals early Thanksgiving night left the holiday cheer at home. Several incidents of violence and theft occurred throughout the country Thursday night. 

 
In Las Vegas, a shopper was shot by a suspect who attempted to steal a TV from him. The suspect brandished a gun, took possession of the TV, and tried to return to his vehicle. The victim followed the suspect and was shot in the leg while trying to recover his property. 
 
In Chicago, a police office was dragged several feet by a car. An officer responding to a call of alleged shoplifting followed the suspect to his car when the car started to move as the officer was half inside it. A backup officer then shot the driver of the car. 
 
Closer to home, at least three people got into a fight in the parking lot of a Wal-Mart in Rialto, California because shoppers were cutting in line. More than a dozen police officers swarmed the retail giant at the Wal-Mart on Riverside Ave after an officer was injured trying to break up a fight between two men. 
 
All the people involved in the fights were taken into custody, but one of the men involved in the fight outside was arrested on suspicion of assault with a deadly weapon and felony assault on a peace officer. Police said he was allegedly kicking the other man in the head when he was on the ground.
 
Raymond Rice, 25, of San Bernardino and Chennel Smith, of Fontana, were arrested after the confrontation outside the store.
