More than 1,700 people have been arrested in the winter holiday DUI crackdown in LA County, according to the Sheriff’s Department. Los Angeles County law enforcement officers have arrested nearly 1,700 motorists on suspicion of intoxicated driving during the last 15 days as part of an annual holiday crackdown.
Between Friday, Dec. 13 and Thursday, Dec. 25, officers from 100 county law enforcement agencies have arrested 1,700 people – almost 100 more arrests this year than during the same period in 2012.The DUI crackdown is part of the Avoid the 100 DUI Campaign and involves checkpoints and directed patrols.
This New Year’s Eve, a Maximum Enforcement Period will be in effect beginning Dec. 31 at 6 p.m. until midnight Jan. 1. One hundred law enforcement agencies are participating in the campaign, and the patrols will continue through New Year’s Day.

Motorist Fatally Crashes Into Mission Viejo Home

Drinking and driving has caused another tragedy this holiday season in Orange County.

A motorist has been arrested this afternoon and accused of driving his car into a Mission Viejo home, killing a resident inside. The home’s layout had a bedroom in the front portion of the home. The driver went through the room, killing the resident inside sleeping in bed. The motorist allegedly has a suspended license and a history of DUIs.

The motorist has been identified as Kourosh Keshmiri, 27, of Mission Viejo. Keshmiri crashed a late-model Cadillac sedan into a bedroom of a home, killing a man who was asleep in bed, authorities said. The house was at least 30 feet from the street. The victim’s identity has not yet been released.

The one-story dwelling sits at a traffic elbow, where Pacato Drive and Olivera Drive meet at a right angle. A car that failed to make the right turn from Olivera onto Pacato would be going straight toward the victim’s residence.

The house sustained major damage, and investigators were checking its structural integrity. Crews repaired a ruptured gas line.

Keshmiri suffered minor injuries, as did a passenger in his car, authorities said. The passenger was interviewed and released.

According to a statement from the Orange County Sheriff’s Department, Keshmiri had a prior misdemeanor DUI conviction in August 2010 and a pending case from June. His driver’s license was suspended as a result of the incident earlier this year.

After Sunday’s crash, officers booked Keshmiri on suspicion of felony DUI with a prior conviction. He may face additional charges after the investigation is complete. Allegedly, alcohol and speed were factors in the collision.
No one else in the home was injured.

OC DUI Cases Could Be Affected by Lab Error

The Orange County Crime Lab error has led to some inaccurate alcohol blood level test results that could affect hundreds of DUI cases.
The Orange County Crime Lab produced inaccurate blood alcohol test results in 2,200 driving-under-the-influence cases filed by prosecutors this year.
Prosecutors in recent days sent letters to people charged with driving under the influence, including 900 whose cases resulted in convictions. The letters advised them that their cases were among those with miscalculations.
Crime lab officials said the “human error” occurred over nearly five months and led to mistakes in the forensic examination of blood alcohol content. But they insist the miscalculations were so few that they affect only about 200 cases. As few as 20 people could see their blood alcohol test levels drop below 0.08%, California’s legal definition of DUI impairment.
However, flaws with the lab’s basic testing probably will affect many more cases because sentence enhancements and negotiations are often based on how far over the legal limit a motorist was determined to be.
Orange County Crime Lab Director Bruce Houlihan said the facility, which serves the entire county, discovered flaws in its analysis Oct. 10 while conducting an audit. In reality, a small human error led to an instrument to be wrongly calibrated. The lab tests each blood sample twice using two machines and then averages the results. The error affected one of the machines beginning May 29. The machine uses five calibrator data points for levels of alcohol in the blood; one was entered incorrectly. As a result, the machine was off by 0.003 percentage points.
About 200 cases will have the blood alcohol average change by 0.01 points. Twenty people will have their blood-alcohol content dropped from 0.08% to 0.07%, below the DUI legal limit.
However, Farrah Emami, a District Attorney spokeswoman, said that though the changes may affect some cases, drops in blood alcohol content below the legal limit do not guarantee that charges will be dropped.
If you or a loved one believe that you may be a victim of the miscalculation in your blood alcohol level by Orange County Crime Labs, it is important to contact an experienced and dedicated criminal attorney at Don Ho Law today to fight your conviction. Our goal at Don Ho Law is to provide an aggressive and comprehensive defense for those accused of a crime throughout Southern California. Television and NBA Star Lamar Odom Arrested for DUI

After a week of rumors swirling Lamar Odom’s recent troubling behavior, the basketball player has been arrested on suspicion of DUI after driving too slowly on the 101 Freeway.

The arrest occurred in a rumor filled week which centered around allegations that Odom is cheating on wife Khloe Kardashian, which later developed into allegations that the basketball star had been using crack cocaine.

Early Friday morning, Odom was going about 50 mph when he was pulled over on the 101 Freeway in the San Fernando Valley. California Highway Patrol officials said he was driving in a “serpentine manner” and actually continued past three exits while authorities tried to pull him over. He showed signs of intoxication and couldn’t pass field sobriety tests, a CHP report said. He refused all chemical tests at Van Nuys jail.

A year ago, Khloe reportedly pressured Lamar into rehab in San Diego, TMZ reports, where he stayed for only three weeks but managed to clean up in time for his season with the Clippers. Kardashian Odom has reportedly kept the alleged circumstances a secret from her notoriously close family until recently.

Odom was arrested just before 4 a.m., booked around 5 a.m. and not released until around 8:30 a.m. Odom’s bail was set at $15,000, according to L.A. Sheriff’s Department records. Odom is due in court September 27 for the DUI arrest.
